David N. Kay OBE
Mr. Kay has served as an arbitrator for over 25 years, hearing domestic and international disputes. Most of the cases involved commercial and business matters across myriad industries and with varying amounts in controversy, the highest claim being close to $1 billion. The parties in dispute have ranged from multi-national companies and conglomerates to small and mid-size entities, limited liability companies, joint ventures, partnerships, sole-proprietorships and individuals.
He is dual-qualified as a barrister in England and an attorney in the U.S. Mr. Kay is skilled in domestic and international business transactions including drafting and negotiating numerous complex commercial agreements. This experience places him in a unique position when sitting as an arbitrator as he understands not only the issues that are of concern to businesses, but also how executed agreements are interpreted by business people in the “real world.”
Mr. Kay’s philosophy on arbitration proceedings and discovery is that arbitrations should be more streamlined and cost-effective than litigation and discovery should be managed by the arbitrator in conjunction with counsel. The scope of discovery should reflect the nature and complexity of the dispute and focus on the key points at issue in the case.
